What is legal expenses insurance? (‘LEI’)
LEI is a form of insurance which indemnifies (pays) your fees incurred by your solicitor in acting for you in various types of claims. Most clients are not aware that they have the benefit of LEI as it is commonly included either free, or for a small additional premium, with the following:
· Vehicle insurance;
· Credit cards;
· Business insurance; and
· Any other form of insurance policy you may hold.
Do I have to use the insurer’s panel solicitors?
The simple answer is no. The Court of Appeal has recently made a ruling that the legal expenses insurance provider cannot prevent their insured from selecting a solicitor of their choice to conduct legal proceedings on their behalf.
Some insurance providers indicate that it is a condition of their policy that you are appointed a solicitor from their selected panel. As mentioned above, this is not the case.
