What is a class action?
The answer is that this is a Court Action on behalf of a large or very large number of Claimants who have the same or a very similar cause of Action. A Class Action will only work if there are the following ingredients present:-
A large or very large number of people (called “the Action Group”) wish to pursue their Claim.
Although there can sometimes be individual variables there must be sufficient commonality as to the nature of the Claims.
The Claim must have substantial merit on legal grounds such as to sustain close examination and ultimately to lead to a successful Court Judgment in the absence of earlier Settlement.
A satisfactory financial structure must be in place to cover the costs of pursuing a Class Action if necessary to its ultimate conclusion. Additionally After The Event Insurance is imperative (in the absence of a separate ring fenced bank account) to protect the members of the Action Group should despite best advice the Claim ultimately turns out to be unsuccessful with a liability for costs to be paid to the other side.
